Lulus Love Rewards Loyalty Program Terms and Conditions

California and Colorado Residents: The Lulus Love Rewards Loyalty Program may be considered a “financial incentive” under California law or a “bona fide loyalty program” under Colorado law. Please review our Loyalty Program and Financial Incentive Notice below.


 
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY ACCESSING OR PARTICIPATING IN THE LOVE REWARDS LOYALTY PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU MAY NOT PARTICIPATE IN THE LOVE REWARDS LOYALTY PROGRAM.


The Lulus Love Rewards Loyalty Program (“Love Rewards”) is operated by Lulu’s Fashion Lounge, LLC (“Lulus”). These Terms and Conditions (“Terms”) apply to your access to and participation in the Love Rewards program. These Terms do not alter in any way the Lulus.com Terms of Service and Privacy Policy, which are incorporated into these Terms. Please review the Privacy Policy carefully to understand how Lulus collects and uses personal information. In the event of any conflict between these Terms and the Lulus.com Terms of Service, the Terms of Service will control.


As discussed in the Terms of Service, you and Lulus agree, with limited exceptions, to resolve all disputes between you and Lulus through BINDING ARBITRATION, as further provided in the Terms of Service. ARBITRATION MEANS THAT YOU AND THE COMPANY ARE EACH WAIVING THE RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.


All Love Rewards benefits, points, awards, and status are subject to availability and may be changed by Lulus at any time without notice. Lulus may terminate Love Rewards, in whole or in part, at Lulus’ sole discretion. Lulus may also choose to substitute a similar loyalty program at any time. If Love Rewards is terminated, all unredeemed points will be forfeited without any obligation or liability.


These Terms supersede all previous terms and conditions applicable to Love Rewards. Except as otherwise expressly prohibited or limited by applicable laws, Lulus may at any time amend, modify or supplement these Terms, the structure for earning awards, points, or tier status at any time, with or without notice, even though such changes may affect the value of accumulated points, or the ability to obtain certain benefits. You are responsible for remaining knowledgeable of the Terms and any changes. Your continued participation in Love Rewards will constitute your acceptance of any such changes to these Terms or the Love Rewards program. If you object to these Terms or any changes hereto or at any time become dissatisfied with Love Rewards, your sole recourse shall be to opt-out of Love Rewards. Lulus shall not be liable to you in any way for any value or benefits you may lose as a result of any changes made to Love Rewards, including, without limitation, any points or rewards.


Love Rewards Eligibility. Love Rewards is a loyalty program offered to Lulus.com account holders. You must be a United States resident (including Washington, D.C.) and at least 18 years of age to participate in the Love Rewards program. Lulus determines United States residency based on your shipping address. If you change your shipping address to one that is not located in the United States (including Washington, D.C.), you will no longer be able to receive or redeem Love Rewards benefits, including previously earned Love Rewards benefits. If you have a shipping address outside of the United States, but are a United States resident, please contact Lulus at love@lulus.com to determine eligibility.


Description of Love Rewards. Love Rewards is a free program to reward our customers for their loyalty. Members receive certain promotional offers and benefits, and have the opportunity to achieve membership in rewards tiers and unlock additional promotional rewards.


Joining Love Rewards (U.S. Customers, Excluding California). To join Love Rewards, simply log into your existing Lulus.com account, or if you do not already have an account, register for an account on Lulus.com and opt in to Love Rewards. U.S. customers with existing Lulus.com accounts as of February 23, 2022 will automatically earn points towards Love Rewards with every purchase. If you are a U.S. customer with an existing Lulus.com account as of February 23, 2022, you must still agree to these Terms to participate in Love Rewards. There are no membership fees associated with the Love Rewards program. You may opt out of Love Rewards at any time by logging into your account on the Lulus website (https://www.lulus.com/myaccount/profile), and selecting the option to opt out of Love Rewards. If you elect to opt-out or cancel your account, you (i) will not be able to redeem any unused Love Rewards Perks or points, (ii) will not be able to retrieve previously-earned points, Perks, or tier status if you elect to opt in at a later time, and (iii) will not be able to earn points for purchases or actions taken while not opted in to Love Rewards.


Joining Love Rewards (California Customers). To join Love Rewards, simply log into your existing Lulus.com account, select “Account Info” and then select the option to opt in to Love Rewards, or if you do not already have an account, register for an account on Lulus.com and opt-in to Love Rewards. There are no membership fees associated with the Love Rewards program. You may opt-out of Love Rewards at any time by logging into your account on the Lulus website https://www.lulus.com/myaccount/profile, and selecting the option to opt-out of Love Rewards. If you elect to opt-out or cancel your account, you (i) will not be able to redeem any unused Love Rewards Perks or points, (ii) will not be able to retrieve previously-earned points, Perks, or tier status if you elect to opt in at a later time, and (iii) will not be able to earn points for purchases or actions taken while not opted in to Love Rewards.


Attaining Tier Status. Love Rewards members will earn points from Qualified Orders, as well as from “earn actions” such as signing up for promotional emails or electing to “follow” Lulus on social media through the link provided on the Lulus website. (All actions taken by you on third-party social media websites or apps must comply with the applicable terms of service for that website or app.) As you earn points, you may qualify for placement in a reward tier, each with its own Perks.


Currently, there are four Love Rewards tiers: Tier 1 (1-299 Love Rewards points); Tier 2 (300-699 Love Rewards points); Tier 3 (700-1499 Love Rewards points); and Tier 4 (1500+ Love Rewards points). Detailed descriptions of the benefits provided by membership in each tier, as well as opportunities for obtaining points, can be found in our FAQs.


Rewards members receive 1 point for every $1 spent on eligible purchases on Lulus.com (“Qualified Orders”), and may potentially earn more points based on promotional offerings. Eligible purchases include regular and sale priced merchandise and exclude gift cards, sales tax, state fees, discounts, shipping and delivery charges and/or other excluded charges specified by us from time-to-time. Points are only awarded based on full dollars spent; purchase prices will be rounded down to the nearest full dollar amount in order to calculate rewards.


To make a Qualified Order through the Lulus website or mobile app, you must be signed into your Lulus.com account when placing the order and keep at least one qualifying item from the order. You can check your orders in the “My Account” Dashboard to see which orders are Qualified Orders and monitor your point total and tier status. If you make a Qualified Order and later return all the items in the order, that order is no longer a Qualified Order and any points earned will be removed from your account.


Points based on purchases will be allocated to your account thirty (30) days after the day that your Qualified Order ships and will be shown as “pending” until such date. If items in the same Qualified Order ship on different dates, points for the entire order will be granted on the date that the last item in the order ships. This includes split orders resulting from backordered items, presale items, or any other reasons. If any part of an order is cancelled after all other items in the order have shipped, any points attributable to that order will be granted at the time of cancellation of the last remaining item.


In the case of “earn actions,” points will be allocated to your Love Rewards account as soon as practicable.


If you collect enough points to qualify you for a new tier, whether from a single order or earn action or when points are added to previous points earned within the earning period (as described below), your new tier status will take effect immediately when the minimum number of points for the applicable tier is allocated to your account. Points earned for purchases that are later returned will be subtracted from your Love Rewards account. If the points attributable to a returned purchase were responsible for increasing your tier status, Lulus reserves the right to reduce your tier status accordingly.


To earn points for a Qualified Order made in Lulus’ Los Angeles retail store, you must email a copy of your receipt to love@lulus.com from the email address associated with your Lulus.com account within seven (7) days of your purchase. If you send the receipt from a different email address, the purchase will not be considered a Qualified Order and the corresponding points will not be added to your account. Points based on qualified in store purchases will be allocated to your account thirty (30) days after the email is received. If you are not a member of our Love Rewards program and wish to earn points for an in-store purchase, you must join the Love Rewards program and then email a copy of your receipt to love@lulus.com from the email address associated with your Lulus.com account within seven (7) days of your purchase.


Rewards, benefits and/or points earned through Love Rewards have no cash value, are non-transferable, and you have no property rights in or to rewards or other Love Rewards benefits. Rewards cannot be exchanged or returned for points, another product or a monetary refund.


Maintaining Tier Status. Once you achieve a new tier status, you will remain in that tier for twelve (12) months, unless your point total qualifies you for an increased tier during that same period. To maintain your tier status, you must obtain a qualifying amount of new points during this twelve (12) month period. If, at the end of this twelve (12) month period, you have not earned enough points to retain your tier, you will be moved to the tier that matches your points earned during that period. This twelve (12) month period is calculated from the date you achieve any given tier. For example, if you achieve Tier 3 on January 1, 2022, then in order to maintain that tier for 2023, you must earn at least 700 Love Rewards points between January 1, 2022 and December 31, 2022.


You must make at least one purchase during your annual rolling year in order to maintain your reward points and tier status. If you do not make at least one purchase, you will lose all of the points you have earned and you will be placed in our entry-level tier, “Member.”


Love Rewards Perks. Love Rewards members receive personalized offers, coupons, and gifts (“Perks”) based on their tier status. Some notifications or offers may be sent by email, and you will need to opt-in to emails from Lulus to receive these notifications or offers; account information such tier status, point totals, and available offers will also typically be accessible by logging into your account on Lulus.com. Perks may be customized based on purchase behaviors and preferences. Perks may have certain restrictions including expiration dates and short, time-limited redemption periods. Read each offer carefully for specific details. Love Rewards and Perks must be redeemed at time of purchase and may not be applied retroactively. Only the account holder may use and access the Love Rewards Perks.


Lulus reserves the right to change the Perks provided to Love Rewards Members and tier status members, and to change the specific Perks offered at various tier statuses. At present the Perks potentially available, based on tier status, include:


  • One-time discount coupons for increasing tier status above Member;
  • Early access to promotions, new arrivals, and back in stock items;
  • Priority back in stock notifications;
  • Exclusive loyalty promotions.



In the future, you may be able to redeem your points for rewards that can be used in conjunction with a purchase on Lulus.com. No redemption opportunities are guaranteed, and any redemption opportunity may be subject to its own terms and restrictions, including expiration dates. If you do not make any purchase during a 12 month period, your available rewards points will expire.


Lulus expressly reserves the right to offer similar (or identical) Perks or other benefits, including participation in promotional offers or sweepstakes, to both Love Rewards members and non-members.


All Perks are promotional only and have no cash value.


Your Love Rewards Account Is Personal. Each Lulus customer may create only one Love Rewards account. The Love Rewards account is personal and may not be assigned, transferred, or shared with family, friends, or for commercial purposes. Love Rewards account and associated benefits are not intended for those purchasing items for resale.


Miscellaneous. Lulus reserves the right to terminate, discontinue, cancel, or change the Love Rewards program at any time, in Lulus’ sole discretion, and without notice to you. Any changes to these Terms will be updated on the Lulus.com website. Lulus also reserves the right to suspend your Love Rewards Perks and/or terminate your participation in Love Rewards if Lulus, in its sole discretion, determines that you have violated these Terms, the Lulus.com Terms of Service, or the Lulus.com Privacy Policy, or if the use of your account is unauthorized, for commercial purposes, deceptive, fraudulent, or otherwise unlawful. In the event that you or Lulus terminate your participation in Love Rewards, then all unredeemed Perks will become void.


Unless otherwise expressly stated herein, the laws of the United States of America and the laws of the State of California, without regard to the principles of conflicts of laws, will govern these Terms, your participation in Love Rewards, and all matters relating to your access to, and/or use of, Love Rewards.


The personal information collected from you in connection with the Program, including but not limited to purchases made in connection with your Program membership, will be used and disclosed by us in accordance with Lulus.com Privacy Policy and the Lulus.com Terms of Service.


Loyalty Program and Financial Incentive Notice. We offer incentives to customers that involve sharing of Personal Information with us.  The Personal Information collected and retained by Lulu’s Fashion Lounge, LLC (“Lulus”) in operating these programs is described in our Privacy Policy, and includes your name and contact details, your date of birth information, your payment information, your contact history with us, your purchase and product feedback history, additional details about you, information about your device type and how you use our website, your public reviews and blog comments and inferences from data and other personal information we may collect in connection with your interaction with our service and/or participation in any of our promotional programs. We may share this information with our affiliates and subsidiaries, service providers, professional consultants, and vendors necessary to complete transactions that you request, and as otherwise described in our Privacy Policy. We do not sell or share your personal information as defined by the CPA.  


Benefits provided through our promotional programs may be deemed a “financial incentive” (e.g., promotional goods) and/or “differential services” (e.g., discounts, coupons, other promotions) under the California Consumer Privacy Act (“CCPA”) and CPA.  We currently offer the following promotional programs in connection with the collection and retention of Personal Information:


  • Love Rewards Program: We offer rewards to customers participating in Love Rewards, consistent with our Love Reward Terms and Conditions above.  Participants in Love Reward receive promotional offers, including discounts, coupons and opportunities to participate in other promotional opportunities.  You can subscribe to Love Reward by logging into your existing Lulus.com account or, if you do not already have an account, registering for an account on Lulus.com. You can join Love Rewards by logging into your existing Lulus.com account, selecting “Account Info” and then selecting the option to opt in to Love Rewards, or if you do not already have an account, by registering for an account on Lulus.com and opting-in to Love Rewards. 
    • The benefits of Love Rewards are described above. The categories of personal information collected through your participation in Love Rewards may be shared for the purposes of targeted advertising include Personal Identifiers, Commercial Information and Internet or other Electronic Network Activity. If you choose to exercise your data privacy rights and request a deletion of your personal information, your Lulus account and any Love Rewards program benefits are deleted. We are only able to provide Love Rewards Program Benefits to Lulus account holders. 


We treat the value of your Personal Information collected through our promotional programs as equivalent to our total program expenses (excluding the value of benefits).  The value of each program is the value of the program benefits, including discounts and coupons, the value of which will depend on individual customer participation.  By participating in our promotional programs, you agree that the benefits are reasonably related to the value of the Personal Information collected and retained. 

 

Participation in our promotional programs is always optional. You may opt-out of Love Rewards at any time by logging into your account on the Lulus website (https://www.lulus.com/myaccount/profile), and selecting the option to opt out of Love Rewards. You can also contact us at privacy@lulus.com to unsubscribe or cancel your participation.
